Abstract

The research aims to analyse the application of restorative justice to traffic crime cases that have resulted in fatalities in Enrekang Regency, and 2). know and analyse the factors that influence the application of restorative justice to traffic crime cases that result in fatalities in Enrekang Regency. This type of research is empirical normative. The results of the study the authors found that: 1) The application of restorative justice to traffic crime cases which resulted in fatalities in Enrekang Regency was not running optimally, because in its application there were no specific regulations governing the process of resolving traffic crime cases which resulted in fatalities. 2) Factors that influence the application of restorative justice to traffic crime cases that result in fatalities in Enrekang Regency include legal substance, legal structure, and legal culture.
